The actual answer is no
one! the question should really be rephrased to "who owns the rights to
use the domain name?".
Most aspiring website owners don't
realise that when they purchase a domain name, what they are actually
doing is purchasing the right to use a domain name for a particular
period of time, after that time has elapsed and unless they use their
statutory right to renew the right to use that domain name can be
transferred to someone else.
Some unscrupulous website designers have
even been known to sign up your domain name in their own name, which
means they actually retain the right to sell, use or dispose of that
domain name in any way they see fit.
It has also been known for people to
offer you domain services in order to glean your preferred domain name
and then simply go-ahead and purchase it themselves in the hope that
you will buy it back from them or their hidden intermediaries, usually
at a hefty premium.
Your only recourse could be to an
attempt to win those rights back via a time consuming &
possibly expensive civil lawsuit.
The way to conquer this potential
problem is simply to choose or decide on your unique business domain
name and purchase the rights to use it before you tell anyone of your
decision or commission anyone to build your website.
